English Smart City User Terms

1. Rules of Registration

In order to use this service, members must agree to the following:

1. Members must provide accurate and up-to-date personal data in accordance with the instructions of the registration form, and shall not register as a member on behalf of a third party. It is recommended that your personal information is continually updated to ensure that this platform can provide the best service possible.
2. If a member provides any incorrect or false data, fails to provide information as instructed, lacks any necessary information, or has multiple accounts registered, this platform reserves the right to suspend or terminate that member’s account(s) without prior notice and refuse future service.
3. Protection for Children and Adolescents:According to Civil Code, if a member unable to make judicial decisions for themselves or is a minor, the member’s parent or guardian should read, understand, and agree to all content within the terms of membership registration before using or continuing to use this platform. When a member uses or continues to use this platform, it is presumed that the member’s parent or guardian has read, understood, and agreed to be bound by the terms of service.

   • consider whether to give consent to adolescents who are above 12 and under 18 before using this platform

Service Description

1. English Smart City reserves the right to change or discontinue its services at any time without prior notice to users if an adjustment in operations is deemed necessary. English Smart City shall not be deemed liable for any user or third party as a result of any decisions to discontinue or change services provided.
2. Under any of the following circumstances, English Smart City reserves the right to discontinue services either temporarily or indefinitely:
   • necessary maintenance and construction of electronic communication equipment
   • sudden failure of electronic communication equipment
   • halting of electronic communication services due to various factors
   • natural disasters
3. English Smart City does not guarantee the following:
   • the ability to operate this platform on all devices, Members must prepare suitable devices in order to download, install, and use the corresponding application properly. The functions available to iOS devices, Android devices, internet browsers, and other existing or future platforms vary in experience. Members must be aware of this when installing this application.
   • satisfaction of the platform and its services provided
   • an interruption-free service in regards to the timeliness of delivery, security, reliability, or the existence of errors
   • accurate and reliable results obtained from this platform and its services provided
   • satisfaction of the information obtained from platform and its services provided

3. Authorizations and Restrictions

1. After paying the related fees for using this platform and its services provided, members will obtain non-exclusive rights, authorized by the company and the relevant copyright owner(s), within the scope of the paid purchase, and can download, read, use, and display the content on their devices. Any content purchased only authorizes members to read, use and display the content for personal, non-commercial use. Beyond the authorization rights explicitly expressed in the aforementioned clause, all other rights are reserved by English Smart City and its licensors.
2. Members are only allowed to utilize the functions provided on the platform to access any and all content. Any attempts to transcribe or extract content for any purpose by using third-party tools without the authorization of English Smart City and its affiliates will result in an immediate termination of services.
3. If a member violates any of the terms or rules listed in this user agreement, English Smart City reserves the right to terminate their account and all rights to the content provided on this platform without notice. No refunds will be provided.

4. Privacy Policy

Member registration and other related information are protected and regulated according to the English Smart City 「Privacy Policy」。

5. Member Accounts, Passwords, and Security

1. After completing the registration process on this platform, members will obtain a specific password and a member account. It is all members’ responsibility to maintain the confidentiality and security of their account details. According to English Smart City’s regulations, any person that logs into an account is presumed to be the creator of the account themselves, whether they personally entered the information or not. All members are held responsible for any actions carried out by their respective accounts.
2. Members agree to the following:
   • When account information becomes compromised or any other security problems occur, the member will immediately notify this platform.
   • Remember to log out each time after using this platform.
   • Each member\’s account, password and interests are only for the personal use of the member themselves. They may not be lent, transferred, or shared with others.
   • When account details are stolen, improperly used, or otherwise, English Smart City will not bear responsibility for any damage incurred unless it is proved to be caused by this platform.
   • If this platform knows that the member\’s account and password has been fraudulently used by others, it will immediately suspend the use of the account (including the processing of transactions generated by the account).
3. Security Features:
   • Members shall not attempt to circumvent, disable or crack any security features or components (such as digital rights management software or encryption) protecting any “course” or “reading software”, or assist, authorize or encourage others to do so. If a member violates any of the security features, there might be civil or criminal responsibilities.

6. Membership Rules

The information on this platform only represents the user’s personal opinion or behavior. Users are responsible for discerning the legality of any content on this platform. This platform and its managers will not bear any legal liabilities for a user’s behavior or the information posted.

1. Due to legal or contractual obligations, do not upload, post, send email, or use any other way to circulate unauthorized content.
2. Do not upload, post, send email or use any other way to circulate obscene content.
3. Do not tamper with this platform or the servers and networks related to this platform, or violate any rules, programs, policies or regulations regarding the network connected to this service.
4. Do not tamper with, collect, store, or delete the personal information or data of other users without legal authorization, or use such data for any illegal or improper purposes.
5. Follow internet etiquette and all legal regulations to avoid offending or influencing others who use this platform.

7. Rules of Responsibility

1. Content providers are responsible for what they upload, post, email, or circulate by any other means on this platform. This content includes but is not limited to the following: information, data, text, software, music, audio, photos, graphics, and videos.
2. This platform may contain links to third-party websites; if you travel to these websites, you should abide by their regulations. They have their own terms of service and privacy policies, which have no affiliations with this platform.
3. By using this platform and its services provided, you have read, understood, and agreed that this platform and its system administrators have no legal liabilities for any inconvenience, data loss, error, or other damage cause to users if there are any interruptions or system failures.
4. This platform cannot guarantee the accessibility, quality, suitability, or degree of censorship of the content and resources provided.

8. Changes of Service, Email Newsletters, and EDMs

1. By using this platform, users have read, understood, and agreed that the service content provided by this platform and English Smart City may increase, decrease, change, or terminated as deemed necessary. Members will not be notified of these changes.
2. By using this platform, users have read, understood, and agreed that this platform may add, modify, or terminate relevant activities as deemed necessary. Members will be notified when these changes occur.
3. By using this platform, users have read, understood, and agreed that this platform and English Smart City may send email newsletters or messages about commodities (EDM) from time to time to the e-mail account registered. You can unsubscribe from these marketing messages at any time.

9. Trading Behavior

1. When members use this platform to make purchases, they still have the right to not accept the order or to cancel the shipment until this platform or English Smart City notifies and confirms the transaction. After a member makes a purchase on this platform, the system will automatically issue a notification of acceptance, but this is not an order confirmation. When a transaction has been completed, the member will be notified.
2. By using this platform, users have read, understood, and agreed that this platform may add, modify, or terminate relevant activities as deemed necessary. Members will be notified when these changes occur.
3. If a member\’s purchasing behavior, such as applying for returns, exchanges, or cancellations on content, is deemed to be too frequent, inappropriate, or damaging to this platform’s operations, English Smart City reserves the right to decline the transaction or permanently cancel the membership depending on the situation.
4. When members use this platform to make transactions, they may exercise their rights in accordance with the Consumer Protection Act. If there is any ambiguity in the terms of service due to a member’s purchasing behavior, interpretations shall be made in favor of consumer.

10. Intellectual Property Rights Protection

All copyrights, patents, trademarks, trade secrets, other intellectual property rights, ownership, or other rights coming from all work and data on this platform and the arrangement of the data displayed on the platform itself are owned by this platform or its rights holder(s). Unless receiving authorization in advance by this platform or the rights holder(s), no one may copy, reproduce, adapt, edit, distribute, transmit, rent, sell, or use the aforementioned items in any other form and for any other purpose, otherwise they shall bear all legal liabilities. Compensation is required according to law.

11. Rejection or Termination of Membership

By using this platform, members have read, understood, and agreed that this platform or the company (Hebron Soft Ltd., AIcity digital Co., Ltd., Curious Bros. Co., Ltd., UNI WILL Co., Ltd.) may terminate a member’s account (or any parts thereof), services provided (or any parts thereof), or remove and delete any “Member Content” from the platform based on the consideration of maintaining transaction security for any reason, including but not limited to the following: lack of use, violation of the explicitly expressed Terms of Service and the spirit. In addition, members must agree that if the services provided (or any parts thereof) are terminated, this platform shall not be liable for the member or any third party.

12. Governing Law and Jurisdiction

The interpretation and application of these terms of service, as well as controversies or disputes related to these terms of service, or arising from transactions between members and this platform, shall be governed in accordance with the laws of the Republic of China, and the Taiwan Tainan District Court shall be the court of first instance to exercise jurisdiction. However, if the law has other mandatory provisions for the court to exercise jurisdiction, such provisions shall still be followed.
